Privacy Policy for United Capital Financial Advisors, LLC

Introduction

Your privacy is important to us. Federal law gives clients the right to limit the sharing of some personal information. In situations where a financial institution does disclose customer information to nonaffiliated third parties, other than permitted or required by law, clients must be given the opportunity to opt out or prevent such disclosure. United Capital Financial Advisors, LLC (“United Capital”) and its affiliates do not share or disclose customer information to nonaffiliated third parties except as permitted or required by law.  The purpose of this Privacy Policy is to explain the data collection and privacy practices of our businesses, including in scenarios where we provide services directly to individuals.

This Privacy Policy applies to information collected through our websites that link to this policy (the “Websites”) which include: www.unitedcapitalwealth.com, guidecenter.finlife.com and hc.finlife.com; any of our mobile applications associated with the Websites or which link to this policy (the “Mobile Applications”) which include GuideCenter and all of our other online offerings that post a link to this Privacy Policy, whether accessed via computer, mobile device, email or other technology or any associated content, material, or functionality contained on the Websites or Mobile Applications (together with the Websites and the Mobile Applications, collectively, the “Services”), as well as information collected from you offline in connection with the services we provide to you.

This provides more information about how we collect and share your personal information and outlines certain choices you may have. If there is a conflict between this Privacy Policy and any privacy notice, disclosure, policies, or terms related to any consumer product, the privacy notice, disclosure, polices or terms relating to the consumer product will govern.

Personal Information We Collect and Generate

To conduct regular business, United Capital collects personal information from sources such as:

  • Information reported by the client on applications or other forms the client provides us;
  • Permission given by you to obtain it from third parties (CPA, attorney, other custodians, websites with your information); and
  • Information about a client’s financial plans, analyses or investment advisory services with United Capital and/or its affiliates.

How We Use Personal Information

For United Capital to administer, manage, service, and provide related services for client accounts, we need to provide access to customer information within our firm and to nonaffiliated companies with whom United Capital has entered agreements with. We may also use your personal information for any other purpose that we disclose at the time you provide, or when we collect, your information, and other purposes permitted by applicable law. We may also use data that we collect on an aggregate or anonymous basis for various business purposes, where permissible under applicable laws and regulations.

If your relationship with us ends, we will continue to treat your personal information as described in this Privacy Policy or as set forth in the applicable privacy notice.

To Whom We Disclose Personal Information

United Capital does not share nonpublic information about a client or former client with anyone, except as permitted by law. When we do disclose this information, it is solely to service the client and their accounts. However, we may provide customer information outside of United Capital 1) as required by law, such as government entities; 2) consumer reporting agencies; 3) certain vendors for marketing, mail services, email delivery, texting services (once the client consents to receiving texts); 4) legal processes/subpoenas; 5) to enforce contractual obligations; and 6) corporate transactions. We also may disclose personal information to others where permissible under applicable laws and regulations or when you provide your consent or direction.

Information collected will not be shared with third parties or nonaffiliated companies for marketing purposes unless the consent is given by the client.

United Capital may also share nonpublic information with affiliated entities such as tax, legal, and insurance affiliates and nonaffiliate companies such as your custodian/broker-dealer. Your information is shared so that your account can be opened and serviced by the custodian and to offer you additional service offerings. Also, if you give consent to sharing your information with a third party, we will do so by acting on your request.

How We Protect Your Information

We take the security of personal information, including U.S. Social Security numbers, seriously and work to limit access to personal information to authorized employees, agents, contractors or vendors. We also maintain physical, electronic and procedural safeguards designed to protect the information against loss, misuse, damage or modification and unauthorized access or disclosures while in our possession.

Retention of Personal Information

We retain personal information for varying time periods depending on our relationship with you and the status of that relationship. When determining how long to keep personal information, we consider our legal and regulatory obligations and our legitimate business interests (such as, managing the Services, preventing fraud, responding to regulatory or supervisory inquiries, and establishing, exercising, or defending legal claims, disputes or complaints).

Children

The Services are not intended for use or view by children under 13 years of age. Consistent with the Children’s Online Privacy Protection Act, we will not knowingly collect information from children under 13. If you are under 13, do not submit any personal information or use the Services. To the extent that we have intentionally collected personal information on our website from a person under 13 years of age, you may request and obtain removal of this personal information.
